  1. Acceptance of Terms

 

By accessing or using the GreenIT Pickup website or our services, you agree to these Terms and Conditions. If you do not agree, please do not use our services.

 

  1. Ownership of Equipment

 

Once GreenIT Pickup removes equipment from your location, ownership of the equipment transfers to GreenIT Pickup. We reserve the right to recycle, resell, refurbish, or dispose of the equipment at our discretion. GreenIT Pickup is not obligated to return any equipment after pickup.

 

  1. Hold Harmless Clause

 

You agree to hold harmless and indemnify GreenIT Pickup, its employees, agents, and affiliates from any claims, damages, losses, liabilities, or expenses arising from:

  • The pickup, handling, recycling, or resale of your equipment.
  • Any loss of data or sensitive information contained in the equipment.
  • Any incidental or consequential damages related to the services provided.

 

  1. Data Security and Liability

 

While GreenIT Pickup uses industry-standard data sanitization practices, it is the customer’s responsibility to ensure all sensitive data has been removed from the equipment before pickup. GreenIT Pickup is not liable for any data breaches or data recovery from equipment after pickup.

 

  1. Limitation of Liability

 

GreenIT Pickup is not liable for:

  • Damage to property during equipment removal unless caused by gross negligence.
  • Delays in pickup due to circumstances beyond our control, including but not limited to natural disasters, labor strikes, or transportation issues.

 

  1. Customer Representations

 

By using our services, you represent and warrant that:

  • You have the legal right to dispose of the equipment.
  • The equipment is free of liens, claims, or encumbrances.
  • You are not disposing of hazardous materials or items prohibited by law.

 

  1. Equipment Eligibility

 

GreenIT Pickup reserves the right to refuse pickup of any equipment that does not meet our eligibility criteria, including but not limited to items containing hazardous materials, broken CRT monitors, or non-IT-related waste.

 

  1. Governing Law

 

These terms shall be governed and construed in accordance with the laws of the State of Texas. Any disputes shall be resolved in the courts located in Dallas County, Texas.

 

  1. Changes to Terms

 

GreenIT Pickup reserves the right to modify these Terms and Conditions at any time. Updates will be posted on this page with a revised effective date.
